Negligence

While discussing a case* of negligence on the part of a school district failing to perform scoliosis examinations required by statute, the question was raised as to "what would happen if we did allow a negligence case for failing to perform?"

For some reason, the answer of "the government would suddenly be in the same position as everybody else" never came up.
